LIMITED WARRANTY

1. Subject to the terms and exclusions set forth below, Pl8tek LLC (“Pl8tek”) warrants that the Pl8tek brand product will be free from defects in materials and workmanship under normal use as described in the published product documentation for 12 months from the date of original purchase (Limited Warranty). This Limited Warranty is only valid and enforceable if you have purchased the product directly from Pl8tek or our authorised resellers and distributors.  It does not apply where you purchase the product from an unauthorised reseller or individual and is not transferable. 
    

2. To the extent permitted by the laws of the United States and any applicable state or local law:
    

   1. our sole obligations under this Limited Warranty are limited to the repair or replacement of covered products at no charge or refund of covered products that prove defective under normal use during the Limited Warranty;
       

   2. in replacing a defective product under the Limited Warranty, we may, at our discretion, substitute a product or model of equivalent nature where the exact product or model is unavailable;
       

   3. this Limited Warranty does not apply to damage caused by failure and damage caused by improper use or abuse, fair wear and tear, accidents, misuse (including failure to follow instructions regarding care and maintenance of the product), neglect, disassembly, alterations or external causes such as, but not limited to, water damage and exposure to excessive force; and
       

   4. we may elect, at our discretion and as an alternative to repairing or replacing a defective product to refund the cost of the relevant product upon it being returned to us.
       

3. All returned parts for which you have received a replacement will become our property.
    

4. To make a claim under this Limited Warranty or if you have any questions concerning this warranty policy, you should contact our customer support team at __________.  All claims are subject to proof-of-purchase clearly showing the date and detail of the purchase.

 

TO THE EXTENT PERMITTED BY LAW, PL8TEK AND ITS VENDORS DISCLAIM ANY IMPLIED WARRANTIES, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR ARISING FROM COURSE OF DEALING OR USAGE IN TRADE. YOU ARE SOLELY RESPONSIBLE FOR YOUR USE OF THE PRODUCT. PL8TEK’S RESPONSIBILITY TO REPAIR, REPLACE, OR OFFER A REFUND FOR DEFECTIVE PRODUCTS IS THE SOLE AND EXCLUSIVE REMEDY PROVIDED TO ITS CUSTOMERS UNDER THIS WARRANTY.  

 

IN NO EVENT WILL PL8TEK BE LIABLE TO YOU OR ANY OTHER PARTY CLAIMING THROUGH YOU AS CUSTOMER FOR ANY DAMAGES IN EXCESS OF THE PRICE PAID BY YOU FOR THE PRODUCT OR FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND OR FOR ANY LOSS OF PROFIT OR REVENUE HOWSOEVER CAUSED WHETHER OR NOT SUCH LOSS OR DAMAGE ARISES AS A RESULT OF ANY DEFECT IN THE PRODUCT OR FROM THE FAILURE OR OMISSION OF PL8TEK.
